Welcome to the Talky App. Please read these Terms and Conditions (“Terms”) carefully before using our App. By creating an account or using the Talky App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

2. Eligibility and Parental Consent
  • The Talky App is intended for use by children under 16 only with the prior consent of their parent or legal guardian.
  • By registering an account, you confirm that:
    • You are the legal guardian of the child user and have provided your consent, or
    • You are at least 16 years old and legally capable of entering into these Terms.
  • Parents or legal guardians are responsible for supervising the use of the App by their child and ensuring compliance with these Terms.
 
 
3. Registration and Account
  • To use the App, you must create an account.
  • You agree to provide accurate and complete information during registration and to keep your information up to date.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
  • Talky reserves the right to suspend or terminate accounts that violate these Terms.
 
 
4. Services Provided

Talky offers an AI-based language learning platform that allows children to:

  • Participate in an interactive language learning game.
  • Receive personalized learning content and feedback.

We may improve, update, or modify the App at any time without prior notice.

 
 
5. Fees and Payment
  • Access to the Talky App requires a monthly subscription purchased by a parent or legal guardian.
  • Subscriptions are billed and managed exclusively via the App Store or Google Play Store. The applicable payment terms, renewal conditions, and cancellation rights are determined by the platform provider and presented to you during checkout.
  • No additional in-app purchases are available.
  • You can cancel your subscription at any time in your App Store or Play Store account settings. The cancellation will take effect at the end of your current billing period.
 
 
6. Intellectual Property
  • All content, software, and materials in the App are the property of Talky GmbH or its licensors and are protected by copyright and other intellectual property laws.
  • You are granted a limited, non-exclusive, non-transferable right to use the App solely for personal, non-commercial purposes.
  • You must not copy, modify, distribute, or create derivative works based on any part of the App.
 
 
7. User Obligations

You agree not to:

  • Use the App for any unlawful purpose.
  • Attempt to access or tamper with systems or data of other users.
  • Transmit any harmful code or interfere with the operation of the App.
 
 
8. Termination
  • You may cancel your subscription at any time through your App Store or Play Store account settings. The cancellation will take effect at the end of your current billing period.
  • We reserve the right to suspend or terminate your access to the App if you breach these Terms.
  • Upon termination, your right to use the App will end after the expiration of the paid subscription period, unless otherwise required by applicable law or platform terms.
 
 
9. Disclaimer of Warranties
  • The App is provided “as is” without warranties of any kind.
  • We do not guarantee that the App will be error-free, secure, or uninterrupted.
 
 
10. Limitation of Liability
  • To the extent permitted by law, Talky GmbH shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.
  • Our total liability is limited to the amount you have paid in the past 12 months.
 
 
11. Governing Law
  • These Terms shall be governed by the laws of Germany.
  • Any disputes shall be submitted to the courts of Berlin, Germany.
 
 
12. Changes to the Terms
  • We may update these Terms from time to time.
  • We will notify you of changes through the App or by email.
  • Continued use of the App after changes means you accept the revised Terms.
 
13. Schools and Educational Institutions

Schools and educational institutions may provide access to the App to their students as part of their educational programs. Schools and institutions are solely responsible for ensuring that all required consents and legal bases are in place to enable students under 16 to use the App in compliance with applicable data protection laws.
